Marxman Lawyers attaches great importance to the satisfaction of our clients. Our firm will therefore make every effort to provide you with the best possible service. Nevertheless, it may happen that you are dissatisfied with a certain aspect of our services, such as the quality of our services or a bill.
In this case, we request that you first present your objections to your own lawyer. However, you can also contact Marxman Advocaten's complaints commissioner, Mr Sebastiaan Palm. The complaints commissioner will handle your complaint according to a procedure, which is described in our complaints procedure.
We will try to find a solution to the problem that has arisen as soon as possible in consultation with you. We will always confirm this solution to you in writing. In principle, you can expect our written response to your complaint within four weeks. If it takes longer, we will let you know in advance, giving reasons.
Marxman Advocaten is a member of the Disputes Committee for the Legal Profession. In the unlikely event that we do not succeed in resolving a dispute in mutual consultation, you can submit the complaint to the Disputes Committee for the Legal Profession up to 12 months after the date of our written response.
Are you a private client? Then the Rules of the Dispute Commission provide for binding advice, unless you still choose to go to the ordinary courts within one month of the complaint being settled.
The Disputes Committee for the Legal Profession is competent to rule on complaints about the quality of the lawyer's services and the amount of the bill. You may also find that you are entitled to damages. The Disputes Committee for the Legal Profession is authorised to rule on compensation claims up to a maximum amount of €10,000. You can only submit higher damage claims to the Disputes Committee for the Legal Profession if you explicitly limit the amount of the claim to a maximum of €10,000, waiving the excess in writing.
Marxman may submit unpaid invoices for collection to the Disputes Committee for the Legal Profession. In that case, binding advice is only given if you deposit the outstanding amount with the Disputes Committee. If you fail to do so? Then arbitration will apply to the collection. The Disputes Committee handles the case according to the Rules of the Disputes Committee for the Legal Profession in force at the time the complaint is submitted to the Disputes Committee.
No appeal is possible against the decision of the Disputes Committee.
